General Terms & Conditions

1. Scope

These General Terms and Conditions (“Terms”) govern all purchase contracts between Stona GmbH (“Stona”, “we”, “us”, “our”) and the consumer (“Customer”, “you”) for goods offered in our online shop at www.iamstona.com.

These Terms apply exclusively to consumers as defined in §13 of the German Civil Code (BGB). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business, or profession.

Stona’s products are intended solely for sale to end consumers. Orders exceeding typical household quantities or appearing to be placed for commercial purposes may be refused, adjusted, or cancelled by Stona.

Any differing or additional conditions by the Customer are not recognized unless we expressly agree to them in writing.

 

2. Contract Formation

The presentation of goods in our online shop does not constitute a binding offer, but an invitation to place an order.

By completing the order process and clicking the button labeled “Pay Now” (or equivalent), the Customer submits a binding offer to purchase the goods in the shopping cart.

The contract is concluded when Stona confirms acceptance of the order, for example through a shipping confirmation email.

Information regarding the ordering process, available languages, and technical steps to correct input errors is displayed during checkout.

We do not accept orders from persons under 18 years of age.

 

3. Prices and Payment

All prices displayed in our online shop are shown in euros (EUR) and include the applicable German value-added tax (VAT) in accordance with current regulations.

For deliveries outside the European Union, the prices shown serve as a net reference price.

No German VAT is charged on such deliveries. Customers in these countries (such as Switzerland) may be subject to import duties, local taxes, and customs fees upon receipt of their order. These charges are determined by local authorities and are the responsibility of the Customer.

All orders are processed and charged in euros (EUR).

Any currency conversion costs applied by the Customer’s payment provider are outside Stona’s control.

Shipping costs, where applicable, are shown separately before the order is completed.

The available payment methods are displayed to the Customer during checkout.

Stona reserves the right to change or limit available payment options at any time.

The goods remain our property until full payment has been received.


4. Delivery and Shipping

Delivery areas, shipping options, and estimated delivery times are displayed to the Customer during checkout.

Stona delivers using recognized logistics service providers. The selection of the shipping provider is at Stona’s discretion.

The risk of accidental loss or damage to the goods passes to the Customer only upon delivery to the Customer or to a person authorized to receive the goods.

If the Customer provides the carrier with a drop-off permission (“Abstellen-OK”) or any similar instruction to deliver the parcel without personal handover, responsibility for the shipment transfers to the Customer once the carrier confirms delivery in accordance with that instruction. Stona is not liable for loss, theft, or damage occurring after such delivery has taken place.

The Customer is responsible for providing complete and correct delivery address information when placing an order. If, after receiving the order confirmation, the Customer notices an error in the delivery address, they must notify Stona immediately by email.

If a shipment cannot be delivered for reasons outside Stona’s control (e.g. incorrect address, refusal of acceptance, or uncollected parcels), Stona may rescind the contract after reasonable delivery attempts. In such cases, Stona will refund the purchase price minus the actual outbound and return shipping costs incurred, even if the original delivery was offered with free shipping.

All undelivered parcels will be processed as returns.

Stona does not deliver to P.O. box addresses.


4.1 Reporting and Documenting Transport Damage

If a parcel arrives damaged, the Customer should inform Stona immediately on the day of delivery by email at hey@iamstona.com, before unpacking the goods.

The Customer should take clear photos of the outer packaging, the shipping label, and the damaged goods to document the condition of the shipment.

As Stona is the contractual partner of the shipping carrier, Stona will handle the official claim process with the carrier. To support this process, Stona may request additional information or documentation from the Customer as required by the carrier’s claim procedure.

This procedure serves only to support the carrier’s damage claim and does not limit the Customer’s statutory warranty rights.

 

5. Right of Withdrawal (Consumers)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, takes possession of the goods.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email).

You may use the model withdrawal form provided below, but it is not mandatory.

 

Consequences of Withdrawal


If you withdraw from this contract, we shall reimburse all payments we have received from you, excluding delivery costs, without undue delay and at the latest within 14 days from the day on which we receive the returned goods.

We will use the same means of payment as you used for the original transaction, unless otherwise expressly agreed.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You shall bear the direct cost of returning the goods.

If the goods have not yet shipped at the time of withdrawal, no return shipping costs will apply.

 

Exclusions

The right of withdrawal does not apply to goods that are made to the Customer’s specifications or clearly personalized (§ 312g Abs. 2 Nr. 1 BGB).

 

6. Returns and Refunds

6.1 Legal Right of Withdrawal

Customers have the statutory 14-day right of withdrawal under §§ 312g, 355 BGB.

Details are provided in Section 5 – Right of Withdrawal (Consumers).

6.2 Voluntary Return Policy

In addition to the statutory right of withdrawal, Stona offers a voluntary 30-day return policy

Customers may request a return within 30 days of receiving the order by contacting hey@iamstona.com.

Stona will provide return instructions and the return address by email.

Returns sent without prior confirmation cannot be accepted.

Once the return has been authorized, the Customer must send the goods back within 14 days of receiving the return confirmation.

Returned goods must be unused, undamaged, and in their original packaging.

Customized or personalized products are excluded from returns.

The Customer bears the cost of return shipping.

After receiving and inspecting the returned goods, Stona will refund the purchase price using the same payment method originally used for the order.

Refunds are typically processed within 14 days of receipt of the returned goods.

This voluntary return policy does not affect the Customer’s statutory right of withdrawal.


7. Retention of Title

The delivered goods remain the property of Stona until full payment has been made.

 

8. Warranty

Customers have the statutory warranty rights under §§ 434 ff. BGB.

If the purchased goods are defective, the Customer may request repair or replacement.

Stona may choose to deliver a replacement if repair is unreasonable.

Warranty claims expire two years after delivery of the goods.

Products by Stona are made from natural materials such as wood and glass.

Natural variations in grain, color, structure, or texture are part of the material’s character and do not constitute defects.

Minor visual differences between individual products or compared to product images may occur due to these natural properties and the handcrafted manufacturing process.

Proper care helps preserve the quality and longevity of Stona products.

Damage resulting from improper handling, storage, or exposure — for example to direct sunlight, excessive heat, or humidity — is not covered by the warranty.

To maintain your Stona products, avoid soaking or submerging wooden components in any liquid, including water, alcohol, cleaning agents, or solvents. Never scrape or use abrasive tools on the wooden components as this will damage the finish.

 

9. Accuracy of Information

Stona makes every effort to ensure that all information, descriptions, and images on its website are complete, accurate, and up to date.

However, minor deviations or variations may occur, particularly due to the natural characteristics of materials such as wood and glass or differences in display settings.

Stona reserves the right to correct any typographical errors, inaccuracies, or omissions and to update or change information at any time without prior notice, including after an order has been submitted.

Such corrections or updates do not affect any existing contractual rights of the Customer.9. 


10. Liability

Stona is liable without limitation for damages caused by intent or gross negligence.

Stona is also liable without limitation for damages resulting from injury to life, body, or health, and for claims under the German Product Liability Act (ProdHaftG).

For damages resulting from a slightly negligent breach of essential contractual obligations (cardinal obligations), Stona’s liability is limited to the foreseeable damage typical for this type of contract.

Cardinal obligations are those obligations essential to the proper performance of the contract, on which the Customer may regularly rely.

In all other cases of slightly negligent breaches of duty, Stona’s liability is excluded.

The above limitations also apply to the personal liability of Stona’s employees, representatives, and agents.

 

11. Privacy and Data Handling

Stona processes personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

Personal data provided by the Customer during the order process will be collected, used, and stored solely for the purpose of processing and fulfilling the order.

Where necessary for order execution, Stona may share data with service providers such as payment processors and shipping carriers.

Any such partners process the data exclusively on Stona’s behalf and in compliance with applicable data protection laws.

12. Intellectual Property

Stona is a registered trademark of Stona GmbH.

All product images, lifestyle photographs, videos, designs, and other visual materials depicting Stona products are the exclusive property of Stona GmbH and are protected by copyright and trademark law.

Additional imagery or media used on this website may include licensed stock content or material from third-party providers, which remain the property of their respective copyright holders.

Any publication, transmission, reproduction, or other use of the content on this website — in whole or in part — is strictly prohibited without prior written permission from Stona GmbH or the respective rights holder.

This includes, in particular, the unauthorized use of Stona product photos, videos, design elements, or the Stona name and logo for commercial purposes.

 

13. External Links Disclaimer

Our website may contain links to external websites operated by third parties.

Stona has no influence over the content of those websites and therefore accepts no liability for such external content.

The respective provider or operator of the linked pages is always responsible for their content.

All linked pages were checked for possible legal violations at the time the links were created, and no unlawful content was recognizable at that moment.

However, continuous monitoring of the content of linked pages is not reasonable without specific indications of a violation of the law.

If any infringement becomes known, Stona will remove the corresponding link immediately.

 

14. Applicable Law and Jurisdiction

These Terms and any contractual relationship between the Customer and Stona are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

This choice of law does not affect the application of mandatory consumer protection provisions of the country in which the Customer has their habitual residence.

The European Commission provides a platform for online dispute resolution (ODR):

Stona is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.


15. Final Provisions

Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.

In such a case, the parties shall replace the invalid provision with a valid one that most closely reflects the original intent.

The English language shall prevail.
